Weingarten Rights

whether you are a dues-paying member of our union or not, you have union rights. In particular, under federal law you have Weingarten Rights.

What are Weingarten Rights? Essentially, if you have a meeting with your supervisor or anyone in power above you that you believe could result in or lead to discipline, you have the right to stop the meeting and ask for a union representative to be present with you. Management cannot take this right away from you. They cannot refuse that right.

Below is language that you can use in such a conversation to request that you have a union representative with you. The role of the union representative is to listen, observe, and ensure that federal law and our collectively bargained contract are followed. You can find your local union leaders at https://vscup.org/.

Example wording: If this discussion, meeting, or telephone call could in any way be related to my being disciplined or terminated, or affect any of my working conditions, I exercise my federal rights and hereby request that my union representative be present. Without their presence, I choose not to participate in this discussion or meeting. Please do not request that I waive this right.

    • If there is supplemental information, please email this info to campus subcommittee members (listed when selecting campus).
    • When reviewing, the following will be taken into consideration: 
      • When was the last request by this employee? 
        • Preference to those that have not requested, or not requested in the last year  
      • Dollar amount requested
      • Reason 
        • Does the reason show a clear development opportunity that helps both the employee and the University? 
      • Available funds
  • How to use VSCUP Professional Development funds (creating a Workday spend authorization & expense report)

Equity

  • We have an entirely new process with the new Agreement for equity. There is no longer an application for an equity adjustment. Per Article 24 of the Agreement, we have the following amount of equity money available:
    • FY25: $75,000
    • FY26: $70,000
    • FY27: $65,000
    • FY28: $60,000
  • The goal of these funds is to help ensure all members are at CUPA median (see Article 24.6 for more). CUPA is a standardized way to associate job description(s) with the median salary of the job description(s).
  • The equity committee (made up of union members and management) are using CUPA information and your job descriptions/responses to the survey and doing their best to utilize the above funds to begin bringing members to CUPA median.
